WHAT ARE THE REQUIREMENTS FOR AN INVESTOR VISA?
Those looking to obtain an investor visa are required to invest in a new commercial enterprise that was established after November 29, 1990 or has been restructured such that a new commercial enterprise results.
A commercial enterprise is a for-profit activity formed for the ongoing conduct of business, such as:
- Sole proprietorship
- Partnership, either limited or general
- Holding company
- Joint venture
- Business trust, either publicly or privately owned
The investment minimum required to be eligible for an EB-5 visa is $500,000 if the new venture is located in a struggling area. This may include either a rural region or a region with a high unemployment rate. An investor may also give $1 million if the business is located anywhere within the U.S. In addition, this investment must cause the creation of at least 10 new full-time jobs within the first 2 years after a person receives their non-immigrant visa.
In addition, you may be eligible for an E-1 or E-2 visa if you reside in one of the United States’ treaty countries and conduct substantial trade activities or who have made considerable investments in U.S. business ventures.
